Online Poker Warrants Ordered Unsealed

August 13 -In the ongoing saga of the seized funds that were earmarked to pay out online poker players in the United States, the US Attorney's office has experienced a setback in its case.
A gaming media company, Costigan Media, filed a motion to have the warrants and affidavits unsealed and made public and the presiding judge, Laura Swain, ruled in their favor.
The media group said that the public had to right to the details outlined in the warrants relating to the seizure, and the judge agreed.
The Department of Justice had argued that the documents were to remain sealed as long as its investigation into the case continued.
However, the judge found that there existed no compelling reasons to have the warrants sealed for longer than necessary.
"The Court is required to order disclosure absent compelling reasons to deny access and even then must employ the least restrictive means of doing so," said Swain in her decision.
The warrants were used by the US Attorney for the Southern District of New York to seize the funds in a number of US bank accounts that were due to be paid to residents of the country who had won money playing at online poker rooms.
The authorities used the Unlawful Internet Gambling Enforcement Act to back their actions.
It is believed that as much as $40 million was frozen and confiscated.
