Dutch Ministry of Justice Says Poker is Game of Chance


October 28 - The Dutch Ministry of Justice will not be changing their opinion about poker being a game of chance in the near future, this according to Minister of Justice Hirsch Ballin following a series of answers which he presented last week. The Dutch Minister of Justice was asked to answer many questions about the current legal status of poker, after a top probability and mathematical statistics professor challenged poker's status.

Professor Van der Genugten, a leading authority in statistics and mathematical probabilities, presented the ministry with a formula which showed the poker actually demanded a far higher level of skill to play the game than other previously-defined games of skill. He thus explained that if poker required more skill than these other games, there was no reason it should not be legally recognized as such a game. In response, however, Ballin said that he would not change his opinion on poker being a game of chance, and would not recognize it as a game of skill.

Ballin also defended the Dutch state's current monopoly on gaming activity through the state-owned Casino Holland. He said that the complete control over gaming facilities was the only way to ensure the protection of Dutch gambling citizens. Referring to a study conducted in 2007 by the Dutch Gaming Control Board and the University of Twenty, which showed that poker had a high risk of addiction, Ballin said the ministry would continue to fight illegal poker operators. He also pointed out that poker is considered a game of chance in 33 other European countries.

Ballin also announced that he would be pushing forward his idea that major financial institutions block transactions between online gaming and poker sites and Dutch citizens, making it almost impossible to engage in illegal gaming activity.
