Kentucky to Challenge Appeals Court Decision


January 27 - In a bid to "protect Kentucky citizens" from internet gambling and poker sites, state authorities have vowed to challenge a recent appellate court's decision barring Kentucky Governor Steve Beshear from seizing the domain names of 141 online gambling and poker sites in the industry.

The Appeals Court overruled a lower court's decision earlier by 3:2, saying that Kentucky was not legally entitled to take ownership of the domain names.

Nonetheless, soon after the ruling, Governor Beshear announced that he would take the decision to the Supreme Court if he had to. This was reiterated in a statement by the Secretary of Justice and Public Safety for Kentucky, J. Michael Brown who said that the "Commonwealth will continue in its action to protect Kentucky citizens from illegal internet gambling operations."

The Poker Players Alliance (PPA), the pro-online poker body that was part of the group of those who petitioned the Appeals Court to block Beshear's moves, reacted to the Governor's statement relating to his future intentions and said: "Kentucky residents should be outraged that the Commonwealth is investing another minute of time and another dollar of scarce resources in this quixotic case."

"The Appeals Court's sound rejection of the Commonwealth case should have ended this legal debacle in its tracks," said the Executive Director of the PPA, John Pappas. "Unfortunately, the Governor and the hired gun attorneys want to drag their ultimate defeat to another venue at the expense of internet freedom and the rights of law abiding Kentucky residents."

As a result of the earlier Kentucky court's ruling, several online poker rooms blocked the state's citizens from playing at their sites, including those on the Microgaming network. This later extended to Microgaming blocking players from all US states.
